The Judiciary Justice be our Shield and Defender e Judiciary is one of the three state organs established under Chapter 10, Article 159 of the Constitution of Kenya. It establishes the Judiciary as an independent custodian of justice in Kenya. Its primary role is to exercise judicial authority given to it by the people of Kenya. It is expected to resolve disputes in a just manner with a view to protecting the rights and liberties of all, thereby facilitating the attainment of the ideal rule of law. e Judiciary and its related institutions, notably Judicial Service Commission, Kenya Law (previously National Council for Law Reporting ), Tribunals and the Judiciary Training Institute perform the following functions: ■ Administration of justice ■ Formulation and implementation of judicial policies ■ Compilation and dissemination of case law and other legal information for the e ective administration of justice In Kenya, courts operate on two levels, namely superior and subordinate courts. e court system has been decentralised with the Supreme Court and the Court of Appeal having their own Presidents and the High Court having a Principal Judge as heads of the respective institutions. e High Court has been restructured into four divisions: Division of Land and Environment; Division of Judicial Review; Division of Commercial and Admiralty; and Constitution and Human Rights Division. e subordinate courts consist of Magistrates’ Courts, Kadhis Courts, Court Martial, and any other court or local tribunal established by an Act of Parliament. Mission To deliver justice fairly, impartially and expeditiously, promote equal access to justice, and advance local jurisprudence by upholding the rule of law. Functions of the O ce of the Chief Justice The Chief Justice is the Head of the Judiciary assisted by the Deputy Chief Justice. e Chief Justice is the President of the Supreme Court and links the Judiciary to other arms of government. e Chief Justice assigns duties to the Deputy Chief Justice, the President of the Court of Appeal, the Principal Judge of the High Court and the Chief Registrar of the Judiciary. He exercises general direction and control over the Judiciary. Hon. Justice Willy Mutunga, Phd, D.Jur, Sc, Egh, Chief Justice and President, Supreme Court of Kenya was appointed Chief Justice and President of the Supreme Court on 22 June 2011. For his outstanding contribution to the development of law, human rights, good governance and social justice, Dr Mutunga received several national and international honours and awards including Senior Counsel, 2003; Lifetime Achievement Award for the Protection and Promotion of Human Rights from the Kenya National Commission on Human Rights in 2003, the Jurist of the Year Award from the International Commission of Jurists Kenya Section in 2003; and the rst Law Society of Kenya Distinguished Services Award for Constitutionalism, Rule of Law and Human Rights in 1988, later named Father Kaiser Award. www.judiciary.go.ke
